1. J&K delimitation: Supreme Court dismissal
GS area: Polity (elections, J&K reorganisation)
The Supreme Court dismissed a plea challenging the delimitation exercise in Jammu and Kashmir:
- Background: after the revocation of Article 370 and bifurcation of J&K into two Union Territories in August 2019, a Delimitation Commission was appointed for J&K.
- J&K Reorganisation Act 2019: the legal basis for J&K's bifurcation into the UT of J&K (with legislature) and Ladakh (without legislature).
- Delimitation outcome: assembly seats in J&K increased from 83 to 90. The redistribution of seats gave more seats to Jammu division relative to the Kashmir Valley, which generated political controversy.
- Constitutional articles involved: Articles 81, 82, 170, 330 and 332 govern parliamentary and assembly delimitation, reservation for SC/ST constituencies.
- Delimitation Commission Act 2002: establishes the statutory basis for delimitation. The commission's orders cannot be challenged in any court.
- Court's ruling: dismissed the challenge, affirming the legal validity of the exercise.

2. Mental healthcare: NHRC report and Mental Healthcare Act 2017

The National Human Rights Commission reported on conditions in 46 government mental institutions:
- Conditions found: "inhuman and deplorable." Overcrowding, inadequate staffing, poor sanitation.
- Illegal confinement: 36.25 per cent of patients were confined beyond their recovery period. The Mental Healthcare Act 2017 mandates discharge when recovery is determined.
- Article 21: the right to life includes the right to live with dignity. Illegal confinement in deplorable conditions is a fundamental rights violation.

3. Custodial deaths: constitutional framework

Custodial death data was published alongside the NHRC report:
- Gujarat: reported the highest number of custodial deaths at 80 over five years, followed by Maharashtra, Uttar Pradesh, Tamil Nadu and Bihar.
- Constitutional violations: Articles 14 (equality before law), 21 (right to life), and 22 (protection against arbitrary arrest and detention) are all implicated in custodial deaths.
- PUCL v. State of Maharashtra (2014): Supreme Court guidelines require that every custodial death be investigated by an independent authority, not the same police station involved.
- NHRC role: the National Human Rights Commission can investigate alleged violations and recommend compensation and remedial action.
- Third-degree methods: the use of torture in custody is prohibited by Article 21, the UN Convention Against Torture (which India has signed but not ratified), and the Supreme Court's D.K. Basu guidelines (1997) on arrest and detention procedures.

4. MSME sector stagnation
GS area: Economy (MSMEs, industry)
A survey of MSME performance found that 72 per cent of micro, small and medium enterprises had not grown in the previous five years:
- Sample: the survey covered a large cross-section of MSME units across sectors.
- Key challenges identified: declining profit margins (cited by 42 per cent of respondents), delayed payments from larger companies (70 per cent), high raw material costs (40 per cent), and statutory compliance burden (52 per cent).
- MSME definition (revised 2020): based on investment in plant/machinery and annual turnover. Micro: investment under Rs 1 crore and turnover under Rs 5 crore. Small: investment under Rs 10 crore and turnover under Rs 50 crore. Medium: investment under Rs 50 crore and turnover under Rs 250 crore.
- MSME share: contributes approximately 30 per cent of India's GDP and employs 110 million people. It is the largest source of non-farm employment.
- Entity Digi Locker: Budget 2023-24 announcement to provide digital document storage for MSMEs, reducing compliance friction.

5. Sea-level rise: WMO warning

The World Meteorological Organisation warned of serious sea-level rise risks for major coastal cities:
- Affected cities: Mumbai, Dhaka, Bangkok, Shanghai, Jakarta are among the high-risk cities globally.
- Causes: thermal expansion of seawater (as oceans warm), melting of glaciers and ice sheets (Greenland, Antarctica, mountain glaciers), and groundwater extraction (which shifts weight and causes land subsidence).
- 2150 projections: under high emissions: approximately 4 metres. Under mid-range emissions: 0.5 metres. Under low emissions: 0.2 metres. The range reflects the uncertainty in ice-sheet dynamics.
- IPCC: the Intergovernmental Panel on Climate Change provides the scientific consensus on sea-level rise. Its Sixth Assessment Report (2022) provided the ranges cited.
- India's coastal population: approximately 250 million Indians live within 100 km of the coast. Major industrial and port cities are on the coast.
- Adaptation options: managed coastal retreat, sea walls, elevated construction, mangrove restoration as natural buffers.

6. Marburg virus: characteristics

A Marburg virus outbreak in Equatorial Guinea drew international attention:
- Marburg virus: a member of the filovirus family (same family as Ebola). Causes Marburg virus disease (MVD), a severe haemorrhagic fever.
- Fatality rate: up to 88 per cent in past outbreaks, making it one of the deadliest known viruses.
- Transmission: direct contact with infected bodily fluids. Fruit bats (Rousettus aegyptiacus) are the natural reservoir.
- No approved vaccine or treatment: as of early 2023. Experimental vaccines were in development.
- Equatorial Guinea outbreak (2023): the first confirmed outbreak in the country. Raised fears of regional spread.
- WHO's One Health approach: connects bat reservoir surveillance to early human outbreak detection.

7. Briefly noted
- Windfall Tax on crude oil: India reduced the windfall tax on crude oil production from Rs 2,100 to Rs 1,900 per tonne. Windfall taxes are levied on exceptional profits earned by energy companies when global oil prices spike beyond a threshold.
- Transfer pricing: an "arm's length arrangement" principle requires that transactions between related entities (parent and subsidiary, or group companies) be priced as if they were between unrelated parties. BBC faced a tax audit examining whether its profits were appropriately reported in India.
- Haircut in debt resolution: when a creditor accepts less than the full amount owed. The IBC (Insolvency and Bankruptcy Code) resolution process frequently results in creditor haircuts. Relevant to the NPA resolution framework.
